1. Introduction
Welcome to NAATIFY ("NAATIFY", "we", "us", or "our").
These Terms of Service ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Services").
By accessing or using our Services, you agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use our Services.
These Terms should be read together with our Privacy Policy.
2. Eligibility
You must be at least 18 years of age to create an account and use our Services.
By creating an account, you represent and warrant that:
- you are at least 18 years old;
- the information you provide is accurate and complete;
- you will keep your account information up to date; and
- You have the legal capacity to enter these Terms.
3. About Our Services
NAATIFY is an online learning platform designed to assist users preparing for the NAATI Credentialed Community Language (CCL) examination.
Our Services may include:
- AI-powered dialogue practice
- Mock examinations
- Audio recording tools
- Pronunciation analysis
- AI-generated transcripts
- AI-generated scoring and feedback
- Vocabulary resources
- Learning progress tracking
- Educational materials
NAATIFY is an independent educational platform.
We are not affiliated with, endorsed by, or associated with the National Accreditation Authority for Translators and Interpreters Ltd (NAATI).
Use of our Services does not guarantee:
- passing the NAATI examination;
- achieving any particular score; or
- obtaining certification.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials.
You agree to:
- keep your password secure;
- notify us immediately of any unauthorised use;
- not share your account with another person;
- not create accounts using false information.
You remain responsible for all activities conducted through your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscriptions and Payments
Some features require a paid subscription.
Payments are securely processed by Stripe or our authorised payment providers.
We do not store your payment card details.
Unless otherwise stated:
- subscriptions may renew automatically;
- renewal occurs at the end of each billing cycle;
- you may cancel at any time through your account settings;
- cancellation prevents future renewals but does not provide refunds for the current billing period unless required by law.
Prices may change from time to time.
Where reasonably practicable, we will provide at least 30 days' notice before price changes take effect for existing subscribers.
6. Free Trials
If we offer a free trial or promotional subscription:
- eligibility requirements may apply;
- we may limit one free trial per user;
- paid subscriptions may automatically commence after the trial unless cancelled beforehand.
7. Refunds
Refunds are provided only where required by applicable law, including the Australian Consumer Law.
Nothing in these Terms excludes any rights you may have under the Competition and Consumer Act 2010 (Cth).
8. Acceptable Use
You agree that you will not:
- share your account with others;
- reproduce, copy, sell or redistribute our content;
- attempt to scrape, harvest or extract platform data;
- reverse engineer or interfere with our software;
- upload malicious software;
- attempt to gain unauthorised access to our systems;
- use automated bots or scripts without permission;
- interfere with other users' enjoyment of the Services;
- use the Services for unlawful purposes.
We may suspend or terminate accounts involved in prohibited activities.
9. User Content
You retain ownership of the recordings and content you upload.
By submitting recordings or other content, you grant NAATIFY a worldwide, non-exclusive, royalty-free license to:
- store;
- process;
- analyse;
- transmit; and
- use
your content solely for:
- providing requested Services;
- generating AI feedback;
- improving your learning experience;
- maintaining platform functionality.
We do not claim ownership of your recordings.
10. Artificial Intelligence Services
NAATIFY uses artificial intelligence technologies to provide:
- transcription;
- pronunciation analysis;
- language processing;
- scoring;
- personalised feedback.
AI-generated outputs are automatically produced and may contain errors or inaccuracies.
They are provided solely for educational and practice purposes.
They must not be relied upon as:
- official NAATI assessments;
- professional advice; or
- guaranteed indicators of examination performance.
11. Intellectual Property
Unless otherwise stated, all intellectual property rights in the Services remain owned by or licensed to NAATIFY.
This includes:
- dialogue content;
- translations;
- vocabulary;
- lesson materials;
- software;
- graphics;
- logos;
- audio;
- scoring methods;
- AI prompts;
- website design.
Except as permitted by law, you must not:
- copy;
- modify;
- distribute;
- sell;
- license;
- reproduce;
- publish;
- create derivative works
Without our prior written permission.
12. Availability of Services
We aim to provide reliable access to the Services.
However, we do not guarantee uninterrupted availability.
Services may be temporarily unavailable due to:
- maintenance;
- upgrades;
- technical failures;
- security incidents;
- third-party service interruptions.
We may modify or discontinue features at any time.
13. Third-Party Services
Our Services may rely on third-party providers for services including:
- payment processing;
- artificial intelligence;
- cloud hosting;
- analytics;
- communications;
- security.
Your use of those services may also be subject to their own terms and privacy policies.
We are not responsible for third-party services beyond our reasonable control.

Educational materials are intended only as learning resources.
16. Limitation of Liability
Nothing in these Terms excludes any consumer guarantees that cannot legally be excluded under Australian law.
To the maximum extent permitted by law:
NAATIFY will not be liable for:
- indirect loss;
- consequential loss;
- loss of profits;
- loss of business opportunities;
- loss of data;
- examination failure;
- reputational damage.
Where liability cannot legally be excluded, our total liability is limited to the greater of:
- re-supplying the Services; or
- the total amount paid by you to NAATIFY during the 12 months immediately preceding the event giving rise to the claim.
17. Indemnity
You agree to indemnify and hold harmless NAATIFY, its directors, employees, contractors and affiliates from claims, losses, damages and expenses arising from:
- your misuse of the Services;
- your breach of these Terms;
- your violation of any law or third-party rights.
18. Suspension and Termination
We may suspend or terminate your account if:
- you breach these Terms;
- you engage in fraudulent activity;
- your use creates security risks;
- we are required by law.
You may delete your account at any time through your account settings.
Termination does not affect rights or obligations that accrued before termination.
19. Changes to These Terms
We may amend these Terms from time to time.
Where changes are material, we will provide reasonable notice by:
- email; or
- notification within the Services.
Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
21. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies referenced within them, constitute the entire agreement between you and NAATIFY regarding your use of the Services.
